General Terms and Conditions (GTC) for Raimund Verspohl-Spring
1.1 These General Terms and Conditions (GTC) apply to all contracts, deliveries and other services between Raimund Verspohl-Spring (hereinafter referred to as the “Photographer”) and the customer.
1.2 Deviating agreements or additions must be made in writing.
2. conclusion of contract
2.1 The contract is concluded when the customer accepts the photographer’s offer.
2.2 The scope of the contractual services is set out in the offer and these GTC.
3. benefits
3.1 The photographer undertakes to provide the services described in the offer.
3.2 Changes or extensions to the services require a separate agreement.
4. rights of use
4.1 The customer shall receive simple usage rights to the photos taken for internal purposes, websites, social media, marketing materials and presentations.
4.2 The rights of use are valid for an unlimited period of time and worldwide.
4.3 Any significant editing or alteration of the photos requires consultation with the photographer.
4.4 The photographer retains the copyright to the photos. A credit to the photographer (Raimund Verspohl-Spring) is requested each time the photos are published. See photo credits instructions.
5. remuneration
5.1 The remuneration for the photographer’s services is based on the respective project-related offer.
5.2 Additional services that are not included in the offer will be charged separately.
5.3 Payments shall be made as agreed in the offer.
6. down payment
6.1 A deposit of 30% of the total amount, as listed in the corresponding booking confirmation, is due upon verbal or written booking, confirmation and/or conclusion of the contract.
6.2 The deposit will be credited in the event of cancellation in accordance with the following cancellation regulations.
7 Cancellation
7.1 Up to 30 days before the date: Cancellation possible without further costs, the deposit will not be refunded.
7.2 Up to 14 days before the appointment: 50% of the agreed fee is due, the deposit will be credited.
7.3 Less than 14 days before the appointment: 100% of the agreed fee is due, the deposit will be credited.
7.4 Cancellation by the photographer: In the event of cancellation by the photographer, the deposit will be refunded in full.
8. liability
8.1 The Photographer shall only be liable for damages caused by intentional or grossly negligent behavior.
8.2 Any further liability is excluded.
9. data protection
9.1 The Photographer shall process the Customer’s personal data only in accordance with the statutory provisions.
9.2 Further information on data processing can be found in the photographer’s privacy policy.
10. final provisions
10.1 The law of the Federal Republic of Germany shall apply.
10.2 The place of jurisdiction for all disputes arising from the contractual relationship shall be the photographer’s registered office.
11. retention period of customer data and photos
11.1 The Photographer shall retain personal customer data for the duration of the contractual relationship and beyond that for the legally prescribed retention periods. After expiry of these periods, the data will be deleted, provided that there are no further statutory retention obligations.
11.2 Commercial and tax documents are kept for the duration of the statutory retention period of 10 years (§ 257 HGB, § 147 AO). Business letters and other documents relevant to tax law are kept for 6 years (§ 257 HGB, § 147 AO).
11.3 The resulting photos shall be stored for up to 3 years after their creation. The photographer reserves the right to delete the photos after this period or at the customer’s request, provided that there are no longer any legal obligations to retain them.
12. cancellation of the shoot due to illness or weather conditions
12.1 Cancellation due to illness of the customer
If the customer is unable to attend the shoot for health reasons, the photographer must be informed immediately. In this case, an alternative date will be agreed without any additional costs being incurred. Any advance payments already made shall remain valid for the alternative date.
12.2 Cancellation due to illness of the photographer
In the event of illness of the photographer, the customer will be notified as soon as possible. An alternative date will be arranged or payments already made will be refunded in full on request.
12.3 Cancellation due to weather conditions
For outdoor shoots, the photographer reserves the right to cancel the shoot due to adverse weather conditions. In this case, a new date will be agreed without any additional costs for the customer. Alternatively, if desired and possible, the shoot can take place at an alternative, weather-protected location.
